Terms and Conditions for Self-Pay Services




Introduction


1.     These are the terms and conditions on which MC Diagnostics supply COVID-19 Antibody Testing Services to you including using any telephone, video conferencing or webchat technology (“The Services”).


2.     Please read these terms carefully before you complete the Shop Payment form and make payment. These terms tell you who we are, how we will provide the Services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.


3.     We are MC Diagnostics Limited. (“MCD”, “we”, “our”) a company registered in England and Wales. Our company registration number is 5843597 and our registered office is at MC Diagnostics Ltd, Unit 5, OpTIC, Ffordd William Morgan, St Asaph Business Park, St Asaph, Denbighshire, LL17 0JD. Our VAT registration number is: 885 9918 41.

5.     If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us.


6.     ‘Writing’ includes emails. When we use the words “writing” or “written” in these terms, this includes emails.


7.     These terms set out the full details and constitute the entirety of your agreement with MCD for the Services. Upon payment to MCD for the Services or the commencement of the supply of the Services (whichever happens sooner) you will be deemed to have accepted these terms. If you do not agree to these terms you should not use the Services.


8.     We may change these terms at any time without providing you with prior or express notice of any such change. You should check these terms from time to time for any changes. By continuing to use the Services you agree to any and all changes made to these terms. 




The Services


9.     The Services are provided as-is, as set out on the MCD webite pages, MCD marketing communications, or as described in our telephone call with you. We may change the Services at any time without giving you prior or express notice of any change.


10.  The Services are only available to individuals located in the UK aged 18 years or over.


11.  You agree not to breach this agreement, any codes of conduct, or any other applicable guidelines that apply to the Services or have been communicated to you by us or breach any laws or regulations.


12.  We may need certain information from you so that we can supply the Services to you. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the Services late or not supplying any part of them, if this is caused by you not giving us the information we need, within a reasonable time of us asking for it. 


13.  We may have to suspend the supply of all or part of the Services to: (a) deal with technical problems or make minor technical changes; or (b) update the Services to reflect changes in relevant laws and regulatory requirements.


14.  We are not responsible for delays outside our control. If our supply of the Services is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.



Payment


15.  The price of the product (which includes VAT) will be the price indicated in our marketing information, on our website or discussed with you when you purchased the Services in our clinic or over the phone or by email. We take all reasonable care to ensure that the price of the Services advised to you is correct. However please see Clause 17 for what happens if we discover an error in the price of the Services you order.


16.  We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the Services, we will adjust the rate of VAT that you pay, unless you have already paid for the Services in full before the change in the rate of VAT takes effect.


17.  It is always possible that, despite our best efforts, some of the Services we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Services correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Services correct price at your order date is higher than the price stated to you, we will contact you before we accept the order. If we accept and process your order where the pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund any sums you have paid.


18.  If you think an invoice is wrong please contact us promptly to let us know.


19.  In providing payment card details, you confirm that you are authorised to use the card and authorise us, or our payment service provider, to take payment in full for the items in your order and any associated delivery fees and any other charges that become due to us under these terms and conditions. The transaction will appear on your bank or card statement as DEZINES ONLINE which relates to our web development partner and marketing agency Dezines Internet Solutions Limited. Payment questions can be made to DEZINES on 0333 444 7 800 accordingly.


Cancellation and Refunds


20.  MC Diagnostics will not offer refunds under any circumstances as indicated below. However, should you have extenuating circumstances, and you wish to cancel your order you should email covidabtesting@mcdiagnostics.co.uk  or call 01745 535225 immediately, even if you have not received your test kit. We will then consider the situation carefully. We reserve the right to approve or decline a refund based on the information provided to us.


21.  Consumers: Ordinarily under the Distance Selling Regulations, when you (as a consumer) purchase the Services online, you have the right to cancel up to thirty (30)  calendar days after the testing kit has been delivered to you. However, our test kits are a bespoke product and unique to each customer. Once opened because it is unique to you as the individual, and because of general healthcare reasons, and because of the risk of covid contamination - we cannot provide a refund under any circumstances. Please do not order if you are not sure about placing an order and making a payment. Your statutory rights are not affected.


22.  Businesses: Ordinarily under the Distance Selling Regulations, you (as a Business) are outside the scope of the Distance Selling Regulations - which are designed for consumer protection. Our test kits are a bespoke product and unique to each business customer. Once opened because it is unique to you as the business and each individual within the business, and because of general healthcare reasons, and because of the risk of covid contamination - we cannot provide a refund under any circumstances. Please do not order if you are not sure about placing an order and making a payment. Your statutory rights are not affected.


23.   Where a Business orders multiple Test Kit products - we will require the names of each individual within the Business. We will contact you for a full list following the oder confirmation.


24.  The box containing the blood collection kit is security sealed with a unique barcoded label.


25.  Your statutory rights are not affected.


26.  Refunds, if approved, will only be made using the payment gateway to the card originally used for payment. Refunds may take up to ten working days to appear on a card statement.


Using The Service


27.  When we receive an order from you to purchase The Service from us, we will confirm that we have received the order by sending a confirmation email to the contact email address that you supplied. Your order is an offer to purchase an item and will not be binding on us until we dispatch a testing kit. Professional codes of conduct and legal restrictions may limit the number and frequency of any item we are permitted to supply to you and, as such, we have no obligation to supply quantities exceeding the relevant permitted maximum and will charge only for those we do supply. We reserve the right to reject any order.


28.  Testing services cover only those conditions and infections that are specified for that particular testing service on this website. All tests that are offered through this website are from MC Diagnostics Ltd - a reputable laboratory, and are of the standards expected for the clinical purpose; but as with all tests, no test can be 100% accurate and all tests are subject to a ‘window period’. The ‘window period’ for each test is made clear on the website.


29.  The blood collection kit will be shipped to you within 24 hrs of your order unless received out of hours (Mon-Fri 9am -5pm), when it will be shipped on the next working day.


30.  Our blood collection kits are sent via Royal Mail using FREE Standard Delivery. You will receive their test kit within 3-5 working days following dispatch. 


31.  You should check the contents of the Blood Collection Kit promptly upon receipt. If there are items missing please contact covidabtesting@mcdiagnostics.co.uk  or call 01745 535225.


32.  Return of a testing kit will be at your own expense unless your statutory rights have been affected.


33.  Please post your sample as soon as possible (ideally on the same day or within 24 hours of sample collection) 


34.  Once the lab has received your sample, you will usually have your result within 2-3 working days, following which we will provide a Certificate if your test has been successful, and add your data into an approved Vaccine Passport application.


Complaints


35.  If you are unhappy with any Services you have received you should contact covidabtesting@mcdiagnostics.co.uk  as soon as possible, giving as much information as you can in relation to the circumstances of your complaint.
